Call Me Sensei Terms of Service and End-User Licence Agreement

1. Agreement and contracting party
These Terms of Service and End-User Licence Agreement ("Terms") are a contract between you and HYPERBOND STUDIO PTE. LTD. ("Hyperbond", "we", "us" or "our"), with its registered address at 111 North Bridge Road, #08-11, Peninsula Plaza, Singapore 179098. They govern the Call Me Sensei application, website, software, content, features and related services (together, "CMS" or the "Service"). For an App Store copy, these Terms are Hyperbond's custom end-user licence agreement.
By downloading, accessing or using CMS, creating an account, or making a purchase, you agree to these Terms and any purchase, offer or feature-specific terms presented to you. If you use CMS for an organization, you represent that you have authority to bind it. If you do not agree, do not use CMS. Where applicable law requires affirmative consent to a term or later change, we will request it.
The CMS Privacy Policy explains our processing of personal data. Third-party stores, devices, networks, providers, links and services may have separate terms and privacy notices. Those third-party terms apply directly between you and the relevant third party where stated.
2. Eligibility and younger users
You must be at least 13 to use CMS or create an account. A higher minimum age applies where required by the law in your place of residence. If you are aged 13 to 17, you must have the involvement or permission of a parent or legal guardian where required, and that adult should review these Terms and relevant purchases with you.
You must provide truthful age and account information. We may refuse, restrict, verify or terminate an account that we reasonably believe is ineligible, unsafe, fraudulent or based on false information. A parent or guardian may report an underage account at support@hyperbond.studio.
3. CMS and AI-generated experiences
3.1 The Service
CMS is a gamified AI language-learning and companion service. It may include text and voice chats, persistent Sensei memories, generated text, speech, audio, images and other content, language-learning tools, relationship and learning progression, romance- or relationship-themed dialogue, scenarios, quests, achievements, reminders, alarms, notifications, call-style experiences, social or sharing features, advertising, virtual items, randomized rewards, one-time purchases, consumable credits and auto-renewing subscriptions.
Features, content, characters, prices, offers, models, providers, availability and technical requirements may vary by device, platform, country, age, account, subscription, test group and app version. We may add, modify, suspend, limit or remove any feature or content, subject to mandatory law and any express rights attached to a completed purchase.
3.2 Fictional AI and output limitations
Senseis and other characters are fictional AI systems, not people. Outputs are generated automatically and may be inaccurate, incomplete, outdated, repetitive, offensive, unexpected, unavailable or unsuitable. CMS does not promise that a Sensei will remember every interaction, behave consistently, remain available, maintain a particular personality or relationship state, or produce any particular result.
You are responsible for evaluating outputs and deciding whether to rely on, save, share or act on them. CMS is not an emergency service and does not provide medical, mental-health, legal, financial or other professional advice. CMS cannot monitor your wellbeing or contact emergency services for you. In an emergency or risk of harm, contact local emergency services or a qualified person.
4. Accounts, security and deletion
You are responsible for your credentials, devices, account activity and the information you provide. You must not share, sell, transfer or rent an account; impersonate another person; create an account through deception; or allow unauthorized access. Tell us promptly if you believe an account or payment method has been compromised.
You are responsible for obtaining any permission required before submitting another person's information, recording a person, uploading a voice sample, or using a name, likeness, image, recording or other content. You must not use voice or image features to impersonate, deceive, exploit or violate another person's rights.
You may initiate account deletion through an available CMS control. Deletion is intended to be permanent and may remove access to chats, memories, transcripts, recordings, generated content, progression, purchases and unused balances or entitlements, subject to the Privacy Policy, mandatory law and platform rules. Some information may remain temporarily or permanently in backups, logs, de-identified data and legal, accounting, fraud, safety or dispute records.
Deleting your CMS account does not automatically cancel a subscription billed by Apple, Google or another seller. Cancel the subscription through the applicable platform before deletion if you do not want it to renew. Hyperbond is not responsible for a renewal caused by failing to cancel through the seller, except where applicable law provides otherwise.
5. Licence and ownership
5.1 Limited licence
Subject to these Terms, Hyperbond grants you a personal, limited, revocable, non-exclusive, non-sublicensable and non-transferable licence to install and use CMS on devices you own or control for lawful personal use. CMS is licensed, not sold. Hyperbond and its licensors reserve every right not expressly granted, including rights in CMS software, models, characters, artwork, interfaces, stories, text, audio, branding, data compilations and documentation.
5.2 Restrictions
Except where applicable law expressly permits it despite these restrictions, you may not copy, reproduce, distribute, sell, sublicense, rent, publicly perform or display, modify, adapt, translate, reverse engineer, decompile, disassemble, derive source code from, scrape, crawl or create derivative works from CMS or its protected content; bypass technical controls; extract models, system prompts or datasets; use automated means to access CMS outside an authorized interface; or use CMS to build, benchmark or train a competing product or model.
5.3 Apple device scope
For CMS obtained through Apple's App Store, the licence is limited to use on Apple-branded products you own or control and as permitted by the Apple Media Services Terms and Conditions. CMS may be accessed or used by other accounts associated with the purchaser through Family Sharing or volume purchasing where Apple's usage rules permit.
6. User Content, feedback and generated outputs
6.1 User Content
"User Content" means prompts, messages, recordings, voice samples, images, files, feedback and other material you submit, create, transmit or make available through CMS. You retain any rights you have in User Content. You represent that you have all rights, permissions and lawful bases needed to provide it and authorize the processing described in these Terms and the Privacy Policy.
You grant Hyperbond a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, cache, store, reproduce, transmit, format, adapt, translate, analyze, modify, display and otherwise process User Content and related outputs as reasonably necessary to provide, personalize, maintain, secure, moderate, support, evaluate, develop and improve CMS; operate Hyperbond's business; comply with law; and enforce or defend legal rights. This licence permits processing by Hyperbond's affiliates, contractors and service providers. It continues for as long as the relevant content is retained and survives deletion to the extent content remains in backups, logs, de-identified datasets, shared copies or records lawfully preserved.
Hyperbond does not intentionally use or submit user chats, audio recordings or images as training datasets for general-purpose AI models unrelated to providing CMS, and does not instruct providers to train such models on that content. Hyperbond and its providers may process User Content and outputs to generate results, personalize CMS, evaluate quality, detect abuse, troubleshoot, secure, develop or improve CMS and supporting services, and comply with law, as described in the Privacy Policy and permitted by applicable agreements.
6.2 Feedback
If you provide ideas, suggestions or feedback about CMS, you grant Hyperbond a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable right to use, reproduce, modify, commercialize and otherwise exploit that feedback without restriction, attribution or compensation, to the extent permitted by law.
6.3 Generated outputs
As between you and Hyperbond, and to the extent permitted by law, you may save, share, modify and use outputs generated for you, including commercially. Outputs may not be unique, may resemble existing material, may be provided to other users, and may not qualify for intellectual-property protection. Hyperbond does not represent or warrant that an output is accurate, lawful, suitable, exclusive or non-infringing. You assume responsibility for reviewing and using outputs and for obtaining any necessary clearance.
7. Acceptable use
You must not use CMS, User Content, outputs, accounts or virtual items to:
- violate law, court orders, sanctions, platform rules or another person's rights;
- exploit or endanger a child, facilitate sexual abuse or exploitation, threaten violence, harass, stalk, discriminate, defame or distribute unlawful or abusive content;
- impersonate or deceive another person, create unauthorized voice or image replicas, misrepresent AI output as an authentic statement, or violate privacy, publicity, confidentiality or intellectual-property rights;
- commit fraud, payment abuse, chargeback abuse, money laundering, identity deception, account trading or unauthorized sale or transfer of virtual items;
- probe, bypass, disable or interfere with moderation, safety measures, rate limits, access controls, technical restrictions, security, servers or networks;
- introduce malware, harmful code or abusive automated traffic; scrape protected content; extract data, models or prompts; reverse engineer CMS; or exploit a defect for unfair gain;
- use CMS or its outputs for high-risk decisions, weapons, unlawful surveillance, biometric identification or any purpose likely to cause unlawful or serious harm; or
- assist another person in doing any of the above.
Hyperbond may establish additional reasonable rules, limits and safeguards for particular features. Those rules form part of these Terms when displayed before or during use of the relevant feature.
8. Purchases, virtual items and subscriptions
8.1 Offers and checkout terms
CMS may offer one-time packs, consumable credits, virtual currency, virtual items, randomized rewards, trials and auto-renewing subscriptions. The checkout screen, store listing and offer terms control the product, price, currency, quantity, billing period, trial, renewal, eligibility and other commercial details for that transaction. Prices may vary by platform, territory, account and offer and may include or exclude taxes as stated at checkout.
8.2 Virtual currency, credits and items
Resonance Crystals, Gems and other virtual currency, credits and items are limited, revocable, non-transferable digital licences. They are not money or property, have no cash value, do not accrue interest, cannot be redeemed or exchanged for cash, and may be used only through authorized CMS features. Unless mandatory law requires otherwise, all sales and transfers are final.
Purchased virtual currency and purchased consumable credits do not expire while your account and the Service remain available. Promotional, bonus or free items may expire if the expiry is disclosed before acquisition. Hyperbond may change the names, appearance, availability, uses, exchange values or technical operation of virtual items, correct errors and balances, and remove or reverse items associated with fraud, misuse, refunds, chargebacks or unauthorized transactions. If CMS is discontinued, any remedy is limited to what applicable law or the relevant platform requires.
8.3 Randomized rewards
Before a purchase that directly provides a randomized virtual reward, CMS will display the applicable reward odds or probability information. Odds, reward pools and availability may change prospectively. Receiving a particular reward is not guaranteed. Randomized rewards have no cash value, are non-transferable and may be subject to age, territory, spending or platform restrictions.
8.4 Auto-renewing subscriptions
Subscriptions automatically renew for the period shown at checkout unless cancelled through the seller before its renewal deadline. Apple, Google or another seller charges the applicable account and manages cancellation, billing and some refund decisions. Cancelling normally stops future renewal but does not reverse the current paid period. A trial may convert to a paid subscription unless cancelled before the stated deadline.

8.5 Refunds, reversals and price changes
Apple purchase refund requests must be made through https://support.apple.com/118223. Google Play purchase refund requests must be made through https://support.google.com/googleplay/answer/15574908. Other purchases are handled by the seller identified at checkout. These Terms do not limit mandatory refund, cancellation, conformity or consumer remedies.
If a purchase is refunded, reversed, charged back or found unauthorized, Hyperbond may remove the related currency, credits, items, subscription period or access, offset a used balance against later credits, suspend paid features or recover amounts lawfully owed. Future prices and subscription fees may change with the notice or consent required by the seller and applicable law.
9. Advertising, promotions and third-party offers
CMS may display Hyperbond or third-party advertising, promotions, sponsorships, referral links and offers. Personalized advertising and cross-app tracking are available only to users identified as 18 or older and where required consent has been obtained. Users aged 13 to 17 receive contextual or non-personalized advertising. Hyperbond does not endorse or guarantee a third party or its products merely because an advertisement or link appears in CMS.
10. Third-party services and providers
CMS relies on third-party services, including Apple, Google, NANONOBLE PTE. LTD. (MiniMax), Alibaba Cloud Model Studio/Qwen, infrastructure, AI, voice, media, analytics, advertising, attribution, moderation, communications, support and billing providers. Hyperbond may add, replace or remove providers and may route requests between providers based on feature, availability, performance, safety, cost, territory or operational needs.
Third-party services may have separate terms, privacy notices, technical limits and availability. Hyperbond is not responsible for a third party's independent acts, omissions, content, security, availability or decisions, except to the extent applicable law provides otherwise. You must comply with applicable app-store, device, network, carrier and third-party terms, and you are responsible for related data, SMS, voice or carrier charges.
11. Enforcement, suspension and termination
Hyperbond may investigate conduct and use automated systems, reports, account information and other available evidence to enforce these Terms. If we reasonably believe an account, content, transaction or activity creates a legal, safety, fraud, payment, security, operational or infringement risk, violates these Terms, or exposes Hyperbond or another person to harm, we may warn the user, remove or restrict content, adjust balances, limit a feature or purchase, suspend access, refuse service or terminate the account.
The response may depend on severity, repetition, intent, harm, evidence and operational needs. We may act immediately and without advance notice where we reasonably consider it necessary. Where practicable and not restricted by safety, fraud, legal process or law-enforcement concerns, we may provide a reason and an appeal route at support@hyperbond.studio. We are not required to disclose confidential information, security methods, internal evidence or information that could enable abuse.
When these Terms or an account end, the licence to use CMS ends immediately. Sections that by their nature should survive continue, including provisions concerning ownership, User Content retained under the Privacy Policy, feedback, purchases, disclaimers, liability, indemnity, disputes and general terms.
12. Hyperbond intellectual property and infringement reports
CMS and all related software, characters, artwork, interfaces, stories, text, audio, branding, trade dress, databases and documentation are owned by Hyperbond or its licensors and protected by intellectual-property and other laws. No right is transferred except the limited licences expressly granted in these Terms.
If you believe content in CMS infringes your rights, contact support@hyperbond.studio with your identity, the protected work or right, the material and location at issue, your requested action, a good-faith statement and any other information reasonably needed to evaluate the report. Hyperbond may remove material, request additional information or forward the report and contact details to the affected user or provider as permitted by law.
13. Changes to CMS and these Terms
Hyperbond may add, modify, suspend, limit or discontinue CMS, a feature, provider, character, model, offer, virtual item or content for product, commercial, technical, legal, safety, security or operational reasons. We do not guarantee continued availability of any free feature, provider, output style or content. For paid services, we will provide any notice, continued access, refund or other remedy required by applicable law or platform rules.
We may update these Terms for similar reasons. We will post the updated Terms with their effective date and provide additional notice where required. Unless applicable law requires affirmative consent, continued use after the effective date constitutes acceptance of the updated Terms. Changes apply prospectively, except that an immediate change may apply where reasonably necessary for safety, security, fraud prevention, legal compliance or to protect rights.
14. Warranties and disclaimers
CMS is provided with the level of skill and care required by applicable law. To the maximum extent permitted by law, CMS, its content, outputs, virtual items and third-party services are otherwise provided on an "as is" and "as available" basis. Hyperbond disclaims implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement and uninterrupted or error-free operation to the extent those warranties may lawfully be disclaimed.
Hyperbond does not warrant that CMS will always be secure, available or compatible; that data or content will never be lost; that defects will be corrected; that outputs will be accurate, safe, lawful, unique or suitable; or that a feature, character, relationship state, provider, price or virtual item will remain available. Nothing in these Terms excludes a statutory guarantee or warranty that cannot lawfully be excluded.
15. Limitation of liability
To the maximum extent permitted by law, Hyperbond and its affiliates, officers, employees, contractors and licensors are not liable for indirect, incidental, special, exemplary, punitive or consequential loss; loss of profits, revenue, business, opportunity, goodwill or anticipated savings; loss, corruption or disclosure of data or content; or the acts or omissions of users or third parties, even if advised that such loss was possible.
To the maximum extent permitted by law, Hyperbond's total aggregate liability arising out of or relating to CMS, these Terms or any purchase is limited to the greater of the amount you paid to Hyperbond for CMS during the 12 months immediately before the event giving rise to the claim or S$100. The limitations apply to all theories of liability and even if a remedy fails of its essential purpose.
Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or another liability or mandatory consumer right that cannot lawfully be excluded or limited. Some jurisdictions do not allow particular exclusions or limitations, in which case they apply only to the maximum extent permitted there.
16. Indemnity
To the extent permitted by law, you will defend, indemnify and hold harmless Hyperbond and its affiliates, officers, employees and contractors from third-party claims, liabilities, losses, damages, judgments, penalties and reasonable legal costs arising from your User Content; your infringement or violation of another person's rights; your fraud, deliberate unlawful conduct or material breach of these Terms; or your misuse of CMS. Hyperbond may control the defence and settlement of a covered claim, and you will provide reasonable cooperation. This section does not require indemnification for a loss caused by Hyperbond's own fraud, wilful misconduct or liability that cannot lawfully be shifted to you.
17. Governing law and disputes
Before starting formal proceedings, send a written description of the dispute to support@hyperbond.studio. You and Hyperbond will attempt in good faith to resolve it informally for 30 days. This requirement does not prevent urgent relief or a time-sensitive regulatory or consumer filing.
Singapore law governs these Terms, excluding conflict-of-law rules, and the courts of Singapore have non-exclusive jurisdiction. If you are a consumer, this section does not remove a mandatory right to use the courts, regulators, alternative-dispute processes or remedies available in your place of residence. Either party may seek urgent or protective relief where reasonably necessary to protect safety, security, confidential information or intellectual-property rights.
18. Apple App Store minimum terms
18.1 Acknowledgement
For CMS obtained through Apple's App Store, these Terms are concluded between you and Hyperbond, not Apple. Hyperbond, not Apple, is solely responsible for CMS and its content. These Terms do not create usage rules that conflict with the Apple Media Services Terms and Conditions or applicable volume content terms.
18.2 Scope of licence
The licence for an App Store copy is the limited, non-transferable licence stated in Section 5.3, including use permitted through Family Sharing or volume purchasing under Apple's usage rules.
18.3 Maintenance and support
Hyperbond is solely responsible for maintenance and support required by these Terms or applicable law. Apple has no obligation to provide maintenance or support for CMS.
18.4 Warranty
Hyperbond is solely responsible for any product warranty that applies and is not effectively disclaimed. If CMS fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price paid for the application. To the maximum extent permitted by law, Apple has no other warranty obligation for CMS. Hyperbond is responsible for other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to an applicable warranty.
18.5 Product claims
Hyperbond, not Apple, is responsible for addressing claims relating to CMS or your possession or use of CMS, including product-liability claims, claims that CMS fails to meet a legal or regulatory requirement, and claims under consumer-protection, privacy or similar law. These Terms do not limit Hyperbond's liability beyond what applicable law permits.
18.6 Intellectual-property claims
If a third party claims that CMS or your possession or use of CMS infringes that party's intellectual-property rights, Hyperbond, not Apple, is solely responsible for investigating, defending, settling and resolving that claim.
18.7 Legal compliance
You represent and warrant that you are not located in a country or region subject to a United States Government embargo or designated by that government as supporting terrorism, and that you are not listed on a United States Government prohibited- or restricted-party list.

18.9 Third-party terms
You must comply with applicable third-party agreements when using CMS, including the Apple Media Services Terms and Conditions and your wireless-data, network and device agreements.
18.10 Apple beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms for an App Store copy of CMS. Upon your acceptance, Apple will have the right, and will be deemed to have accepted the right, to enforce the applicable Terms against you as a third-party beneficiary.
19. General
19.1 Notices and electronic communications
Hyperbond may send notices through CMS, the website, an app-store listing, push notification, account message or the email linked to your account. You consent to receive legally permitted electronic communications. A notice to Hyperbond must be sent to the contact details in Section 20.
19.2 Assignment and corporate changes
You may not assign or transfer these Terms, your account or your personal licence without Hyperbond's written consent, except where mandatory law allows. Hyperbond may assign or transfer these Terms, in whole or part, to an affiliate or in connection with a financing, reorganization, merger, acquisition, asset sale or transfer of CMS, subject to applicable law.
19.3 Events outside reasonable control
Hyperbond is not responsible for delay or failure caused by events outside its reasonable control, including telecommunications or cloud failures, provider outages, cyberattacks, natural events, labour disputes, public-health events, governmental action, war, civil disorder or changes in law, except to the extent applicable law provides otherwise.
19.4 Severability, waiver and interpretation
If a provision is unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions continue. A delay or failure to enforce a right is not a waiver. Section headings are for convenience. "Including" means including without limitation.
19.5 Entire agreement, language and third-party rights
These Terms, checkout details and any feature-specific terms presented before use form the entire agreement about CMS and supersede prior statements about the same subject. The English version controls to the extent permitted by law. Mandatory local law prevails over an inconsistent term. Except for Apple as stated in Section 18.10, no third party has a right to enforce these Terms.
